You cannot create, publish, transfer or distribute mass e-mail messages (also known as “SPAM”) without Dot5Hosting`s prior written consent, which are in any event granted or refused at Dot5Hosting`s sole discretion. In addition, you may not send emails containing a Dot5Hosting affiliate link and a message about Dot5Hosting or the Dot5Hostings affiliate program to people who have previously agreed to receive such messages. Your failure to comply with this Section 14, the 2003 SPAM LOI, our anti-spam policy and all applicable e-mail communications laws is considered by you to be a major violation of this agreement and leads you to retain all commission rights and termination of your participation in the affiliate program. If your account has excessive clicks in a very short period of time, as defined by Dot5Hosting at its sole discretion, the affiliate relationship may be broken. This affiliation agreement (“the agreement”) contains the terms and conditions between us, Dot5Hosting (“Dot5Hosting”) and you regarding your application and participation in, the Dot5Hosting affiliate program (the “affiliate”) as a partner of Dot5Hosting (an “affiliate”) and the creation of links from your website to our website, www.Dot5Hosting.com. “Affiliate” – The company, entity or entity that applies or participates in the affiliate program, or displays Dot5Hosting`s products and services and/or promotions on its website or by any other means by using an affiliate tracking code to obtain a Dot5Hosting commission. We can, at any time, amend this agreement at our discretion; provided that the change only applies to events that occur after the date you accept these changes and accept them, unless you accept something else. These changes will come into effect when they are published on our website. Changes may include changes to the amount of commissions available, commission amounts or percentages, payment procedures, commission payment plans and rules governing the affiliation program, but are not limited to this. If an amendment is not acceptable to you, your only recourse is to terminate this contract, in which case you are entitled to your rights under the unchanged contract before the date of the applicable amendment. Your continued participation in the affiliate program after a change is posted on our website is a mandatory acceptance of the change.
Affected customers who purchase Dot5Hosting products and services through our affiliate network are considered Dot5Hosting customers. Dot5Hosting`s terms and conditions, rules, rules and operating procedures apply to these customers. We can change our policies, prices and operations at any time.
